EXTENSION OF TWO EMPLOYMENT VISA CATEGORIES
An extension of both the Employment Fourth Preference Certain Religious Workers (SR) and Employment Fifth Preference Pilot (I5 and R5) Categories was signed into law in late September. As indicated in item D of the Visa Bulletin which announced the October final action dates, the extension has resulted in the immediate application of the following final action dates for the month of October:

What is a nonimmigrant visa?
A nonimmigrant visa is for short-term visitors to the United States. You cannot stay in the United States permanently on a non-immigrant visa, and you generally cannot work.
We are aware that some DACA (Deferred Action for Childhood Arrivals) recipients may have submitted requests for renewals that have been pending longer than normal processing times. We make every effort to adjudicate cases within 120 days, whether they were filed timely or not. Timely filed cases are those that were submitted at least 120 days before the expiration of the current period of DACA and the employment authorization document.

1. Be alert and aware of the possibility of a site visit at the beneficiary’s work location, even if the work location is at a third party worksite. It is important that H-1B/L-1 employers have policies and procedures in place in case of an FDNS inspection. Human resource departments, staff, and company signatories should be aware of the potential for unannounced site visits and should be prepared to follow the employer’s response plan.
