ICE posted a news release yesterday that outlines updated policies and procedures with regard to custody determinations involving individuals with criminal convictions.
According to the release, ICE is instituting enhanced supervisory approval for discretionary release of certain categories of individuals with criminal convictions, including those convicted of two or more felonies or any single aggravated felony. Additionally, the release states that ICE will not treat detention capacity as a determinative factor in the release of an individual with a serious criminal record.
